Also, people whining about the devs 'breaching the countract' are forgetting that there's a likely chance that the company was in breach of the contract first. Now, one doesn't neccessarily excuse the other in eyes of the law but it does serve to look for the circumstances. No doubt Activision is guilty as sin since they admitted to stealing money from people and purposefully firing people as an excuse not to pay them money owed. That's disgusting. But with a fear of being blacklisted by every publisher I don't see anyone within the industry standing up for an union, mostly people who get fed up and leave. What ? I don't understand what you mean. If the poorly treated developers want justice they would organize and form a union. When the union has enough developers in it, they can and will achieve better working conditions. You can't blacklist the whole union. Now the only thing working against this is laws that govern individuals rights against illegal contract termniation i.e. job security. If the local law does not provide protection from being fired illegaly (term defined by each society by their norms) then you truely are ****ed. To put it into perspective is like being the first person to jump forward after the bad guy with the gun says "who dies first?" sure you can overwhelm him with massive numbers but without the certainty of a backing and with a job to lose, I don't see many people lining up to be the first. As for the illegal termination, well those cases drag out and even if you win and actually start an union you are still going to be a troublemaker in the eyes of the publishers. I'd say the answer to that question is kind of like the answer to "who's the sucker in this poker game?"* *If you can't tell, it's you.

ACTI has admitted to witholding bonuses from employees no longer with the company. That's theft. So, yeah, they are guilty as sin and they've been doing it for awhile which is one of the many reasons why the employees (not just the two founders) have been quitting left and right. You cna't have bonuses promised in a contract for passing milestones that are passed and then refuse to pay them. Period. ACTI are scumbags. Just admit it. let's not forget the act of false imprisonment of employees as they brow beat them, threatened them , etc.,e tc. as well ACTI wishes we would. It's the quintessential workplace dilemma that I'm sure many of us have seen. An operator or field guy is the best at his role but poor at managing staff or leading teams. So they go for the Roman slave galley approach instead and end up with this sort of scenario. Conversely, you get the professional 'generic' manager who thinks IT is the same as retail is the same as marketing is the same as... and this guy is a **** too. Anyhoo, that McNamara doesn't deny it sets him apart from the herd, but that doesn't mean I'd want to work for or with him. Or are you still under a non-disclosure agreement? :: shrugs :: It's no biggie, but there were long hours, unhealthy peer-pressure and bullying. You'll never eradicate that, but it's much better in my industry now.

It's good, but it's probably the top of the list for games I wouldn't have regretted missing while not actively disliking. It doesn't seem to justify that 7 year development time. They could have something built in so that they have to wait out the financial quarter before getting their bonus, or that they have to actually, you know, do their jobs correctly to get it. As to the imprisonment thing, I don't know if what they did was technically illegal. From what little I've read on the subject it can be pretty murky. Victor of the 5 year fan fic competition! It's a useful skill to have particularly where you aren't allowed to call people names. It's a mistake to get too drawn in/worked up. I mean it's not life or death, it's just two guys posting their thoughts on a message board. If it were personal or face to face all the usual restraints would be in place, and we would never have reached this place in the first place. Try to remember that.
