Austrailia + Porn= hate

Recently Austrailia has passed a few interesting bans, One being that porn that includes breast sizes A cup or below can no longer be sold, and the other being that female ejaculation is considered "refuse".

Whatta smeg. Oh jesus, this **** is why I vote Greens (whatever your crazy thoughts on their environmental stance is - they at least have the Senate power to control legislation). And why I really really do not ****ing trust the government to handle a web censorship scheme.

 

The problem is that this crap doesn't appear to be legislation. It's just the whims of the censorship authority.

 

Even if you are 18 years old but you look younger, taking a photograph of your breasts and uploading it to the Internet could land you or someone you know in serious trouble.

Mangaka= the guy drawing manga (you know, karate->karateka?)

Eroge means pr0n. Hentai is a bad translation (means weird/pervert originally).

**** on this, it's not legislation and I can't imagine that the ruling will stand once someone gets it into court. Basically this means taking naughty pictures of your girlfriend assumes you are a paedophile.

From what I've seen out of Japan, that seems like a perfectly appropriate translation to me.

True enough. To be fair, the weird stuff is usually played for laughs.

If you'd bothered to read the thread, these 'laws' were passed by an independent body - the media regulator. This is not legislation and it seems pretty flimsy to call it law. While it was passed by a government body, it was not passed by parliament - what most people consider government.

Think it would hold up under legal scrutiny?

I do not know. If it went to the High Court it'd probably get shot down. They're pretty damn strong on civil rights. If it got there.

 

It's worth pointing out the legal status of this material (Refused Classification):

 

Classification is mandatory, and films that are rated Refused Classification by the OFLC are banned for sale, hire or public exhibition, carrying a maximum fine of $275,000 and/or 10 years jail. It is legal to possess Refused Classification material, unless it has been rated Refused Classification due to illegal content (e.g. child pornography).

 

It's legal to possess, but not legal to distribute, and I believe not legal to import, though perhaps it's simply the case that it would be confiscated at Customs and you'd be sent on your way.
