I say you arrange for an accidental incident in which his precious retarded-user-safe Mac somehow (w/ no fault to yourself of course) is exposed to a morphing BIOS level worm.   2. Jags, this article argues two points that she was surrounded by her own supporters. The only way she could have avoided suicide bombing is the same one everyone has to use, varying her routes, and applying total secrecy. But she was clearly ignoring the risks in order to raise her profile. Performing those PR functions was part of her role as a democratic politician. Given that the presidential elections are coming up, a desire to raise one's profile is not only reasonable but categorically required to effectuate the electoral process. As someone whom purports himself to be a democrat, Musharraf should have a vested interest in doing everything reasonable in his power to protect his fellow democratic candidates from foreseeable dangers. Given that terrorists attempted to assassinate Bhutto with bombs on her very return, Musharraf knew or should have known about the dangers posed to her. And assuming he's some kind of idiot who can't even appreciate such risks, the senators' requests should have hammered in the presence of the foreseeable danger. But for the denial of the detonation jammers and bomb detection equipment requested, her death would not have occurred. So Musharraf's denial was an actual cause and a substantial factor in bringing about her death. To vitiate all blame on Bhutto's stipulated assumption of the risk would not be correct. From the article, it appears that she did everything reasonable in her power to prevent the bombing in the circumstances of her status as an upcoming presidential candidate. I understand what you're saying though. But applying total secrecy, etc would be an option for perhaps a hermit whose need to interact with the public is remote. Partial blame can only be attributed to Bhutto if she acted unreasonably in voluntarily exposing herself to known risks, or that her standard of care fell below that which was reasonably required for her own protection. I don't think either is the case.

Here in the US, the courts will enforce contracts of adhesion ("take it or leave it" deals from the offeror which leaves the offeree no capacity to negotiate), UNLESS the term being assented to is objectively outside the scope of teh offeree. That is to say, a person not creating the contract (but agreeing to the contract) would reasonably be expected to agree to that term given the surrounding circumstances of the purported deal. As such, the enforceability of say, signing away a right, cannot be conclusively absolute in the abstract, but is dependent on the facts of the case. So in your previous example of termination of WoW accounts, they would do an objective test of whether a WoW user would reasonably expect the termination of his/her account to be within the scope of the his contract with Blizzard. And very likely the courts would indeed deem it to be so (as opposed to say giving Blizzard permission to bulldoze your house). The above is the majority way the US handles contracts of adhesion. The minority way a few states do it is via a subjective test of whether the seller knew that if the buyer was aware of the term (i.e signing away a right) then he/she would not have agreed. But that's only done in a couple states so it's not very prevalent.

  18. It sounds like you're not getting sufficient frames per second. If this is on the PC, then it might be that your video card is not up to scratch. Click on "start", then "run", and type in "dxdiag". Then click on the display tab, and let us know the name, chip type, and total video memory that appears in the device sub-heading.
  19. Yeah, but you guys have to consider that The Witcher and MotB are not what you would call high fantasy. Here they may seemed be cloaked in a high fantasy setting, but The Witcher is more of visceral modern-day allegory, while MotB's use of hags and witches (instead of elves, dwarves, etc) heavily draws inspiration upon shamantic and tribal mythologies across the world.

The courts will enforce EULAs when the user ticks that little "I agree" checkbox on the dialog box of installation wizards, but they won't enforce agreements when clicked through URL links. Are you sure? From my understanding, they haven't actually been tested. I'm positive. Well, at lest in our good 'ol USA. Any additional terms raised in the digital iteration of the agreement that the user assents to are called "click-wrap" contracts, and there is a split of opinion of when they're enforceable. Note that these are different from "shrink-wrap" contracts, such as box-top licenses. Those are considered to act as mere confirmations. So if the company sneaks in additional terms on the box of your software, then they won't be enforceable (Step-saver vs. Wyse Tech). But going back to the "click-wraps", if the user assent is provided via the EULA dialog box, then the terms are binding (ProCD vs. Zeidenberg). However, agreement to terms via clicking through URL links are not enforceable: (Specht vs. Netscape Communications) ^a direct wiki link to the last url won't work for whatever reason, but if you scroll down there should be a link to the case.
  21. I would say that if you're going for a melee character who primarily deals damaged with the swords, then specialize in Aard and Quen (in addition to str, dex, and stam). If you're going for a magic damaging character then pump Igni, Int, and all mana boosting/regenerating skills.

  23. Probably not, but they should. Some of them are pretty crazy in what they get you to agree to. i.e. obtaining your consent to leach a tiny bit of your bandwidth for their network lattice-frame purposes.
