The first video shows that a few outnumbered law enforcement officers are unwilling to escalate the situation after confronting an angry crowd in the middle of nowhere. Some seemed willing to talk it down but after the the failed tasering, the crowd isn't exactly receptive. I'm actually impressed that no one was beaten down and arrested. I suppose reinforcements were dispatched shortly after? I chuckled when the guy recording said "I'm recording your brutality". When adrenaline kicks in it's hard to remember that cops are people too. This isn't an easy one to explain as there are many facets to the situation, just about all of which are outside the realm of the knowledge of your average layman. Probably the biggest one though is the issue of jurisdiction over the land Bundy's family has had their cattle grazing on for what he claims is close to a century and a half at this point. He contends that the BLM (Bureau of Land Management), a Federal agency created in 1946, has no jurisdiction over the land they claim to, as the Federal government has no jurisdiction there. Constitutionally, he is correct, however the reality is that most people are ignorant of this fact and that those that could best defend him, his local county and state government will likely not come to his aid. Sadly, and to the great detriment of many a person in the U.S., like some other parts of the U.S. Constitution, Article 1, Section 8, Clause 17 has been generally ignored by congress since the latter part of the 19th century, and with a few exceptions the States have not taken them to task over it, for a variety of reasons, though the 17th Amendment is probably the biggest. It is still definitely the law of the land though, just one that's often ignored, especially in the western U.S.. There is actually an ongoing lawsuit or two by some states (Utah is one, I can't recall the other(s) at the moment) to force the Federal government to relinquish their claims on the land within various states to which it really has no Constitutional authority, yet has been exercising it largely undisputed for quite some time (not as long as Bundy says he's been in Nevada though). I know it may come as a shock to most (and the ignorant probably wouldn't believe it or ever do their homework to see that it's true), but most of what is considered Federal land within the U.S., Constitutionally belongs to whatever state that land happens to be in, with that state, it's counties, and municipalities have jurisdiction therein (Bundy has said he'd have no problem paying grazing fees to Clark County or Nevada itself). Over the years some states have sued over a piece of it here or there, and even won, but they've not sued for all of it until recently. There is a growing movement for this to be done in the various states where it's an issue (generally the western states as earlier in the nations history when the more eastern states were admitted to the Union, Congress still heeded the Constitution quite a bit better than it did towards the end of the 19th century, during the 20th, and now.) On legal grounds, Bundy's situation is indirectly on a huge issue, though there is potential for direct influence in at least some small manner. At the end of the day he will unfortunately unlikely win his personal battle in regards to his ranch and cattle, but in the long run what is currently happening in Nevada may have some affect on the aforementioned ongoing lawsuits and influence potential new ones. Many states in general are increasingly apt to sue the Federal government of overreach of it's Constitutional power in recent years. This is a trend that is likely to continue to grow as there is increasing resistance/backlash to the overreach as it grows amongst State and local governments throughout the U.S., and of course amongst it's people. There are a number of other aspects to Bundy's situation, as well as the jurisdictional aspect of it that I mention above. Tortoises, environmentalists, solar farms, probable government corruption, and possibly oil being some of them. Bundy's situation aside, the BLM has in the past been involved in some very shady things in regards to the use of the land it claims jurisdiction over (some good recent examples are pointed out in the documentary 'Gasland', which concerns the practice of hydraulic fracturing for oil/natural gases). I think you need to put quotation marks on the "dealt" part, the state seems to not know or care (worse yet if they condone it) and the government is far too big for any man to fight alone. Plus by the time you can take legal action the government will have likely taken hold and made use of the land and will be very unlikely to give it back. Ultimately seems a case of might becoming legal right. I'd say the answer to that question is kind of like the answer to "who's the sucker in this poker game?"* *If you can't tell, it's you.

The land in question is not federal but state land. The state never ceded it to the Federal Government so where is BLM's standing to impose fees? It is legal to graze cattle in public land in Nevada and the family had been doing so long before the BLM came into existence. If anything then the state had standing to remove the cattle and/or impose fees but they never have done so. Bundy has said he'd pay range fees to Carson city but not Washington. I don't blame him. Then the story breaks that the Senate Majority Leader wants that land to sell to a Chinese power company in a deal his own son would broker. That scent you are smelling is not cow manure. Why was that story not page one news? Oh, yeah, he's a Democrat. It's not corruption when a democrat is doing it apparently. I find it telling the difference in behavior of the BLM agents when they knew no one was armed. Bundy's son was tasered, beaten, then arrested on a VERY questionable charge for video recoding the round up (which is perfectly legal). Now armed supporters and self titled "Militia Members" are pouring in from all over the west to support the Bundy family and the BLM becomes a little more circumspect. I am happy that cooler heads at the BLM have prevailed and they have backed down from what was quickly becoming a situation where an armed confrontation was likely, however had they been a little less bellicose and heavy handed it would not have gotten out of control this way. Unfortunately, government is force. it does not know any other way. On a side note, do any of you still doubt that privately owned firearms can be an effective deterrent against government abuse? It's not about cow grazing.... ... and tell that to the numerous government agents that every day bear arms, threaten physical violence, employ physical violence, threaten death, and sometimes murder all in the name of government, to enforce their or it's will. In this situation an estimate 200 armed government agents with guns and other military gear showed up to corral some cows. Usually when they are hell bent of seizing your property and freedom no matter the pretext their policy is to shoot everyone in sight indiscriminately. Ruby Ridge comes to mind where the penalty of missing a court date is summary executions of the entire family. Cows are not worth killing for. But defending freedom and property is. And it would be worth dying for if it came to that. Today those folks in Nevada drew a line in the sand and dared the BLM to step over it and God Bless them for doing it. The BLM declined and God bless them for that. But the confrontation is coming at some point. It's been building for years. When we start seeing the Federal government coming to take the homes and farms of good tax paying and god fearing Americans? This could be the beginning of the great and inexorable move by the Federal government to absorb or neutralize anything that doesn't conform to its socialist policies. What if one of the militia's had decided to provoke the Feds, its quite possible. One of the federal authorities gets shot by an extremist in order to deliberately to cause a conflict. There would have been multiple casualties but end of the day the Feds would have won because obviously they have more manpower and access to better weaponry. Even though I respect the right of gun enthusiasts worldwide to own gun and enjoy their hobby. Guns don't give you respect, unless you mean the same kind of "respect" that you get in gang neighborhoods ... "Guns" The only guy there that deserved any kind of respect is the one who tried to defuse the situation and called for people to comply with orders. You want respect go to court and win, you don't get respect by sticking it to "the men" crying aggressors, because the government don't give a **** and "the men" you stick it to is a regular joe's like you with a very hard job to enforce a court decision. Extra points if you understand that your "protest" is meaningless and will change nothing, unless you effect anyone in power to effect court order, which is usually done by generating public outrage, in this case by agitating and escalating the situation to get coverage in the news.. so who needs the actual defending, you or the cops? as for the guys who feel they need to bring guns to the "party"(like that COD kid in second vid with his "rules of engagement"), you can chant second amendment all you want, but to me you are the same gun nuts like the ones you generally see in in middle eastern countries minus the shooting in the air and chanting Alah akbar. 2
