Nepenthe Posted April 24, 2013 Posted April 24, 2013 It's funny, most people argue that they are buying a physical item analogue, and thus claim that their rights to use it shouldn't be limited in any way up until the moment they lose the discs and then start saying that because it's digital, they should replace it for free. I like it, its very difficult to dispute "lawyer logic " More like a nasty habit from having to dig holes into other people's logical or "logical", if you will, statements for a living. I think more people should just own up that whatever they are doing is, at the very least, amoral instead of creating these complex constructions for justifying it. But I know it's a useless hope, from the way people can't accept that liking games is a subjective situation as well, and spend a lot of time making these same constructs in a futile attempt to prove that their opinion is objective reality. No deception like self deception, I guess. That said, personally I think I've DL'd to replace lost discs, even if in my case it tends to refer to something from floppy disc days that I couldn't replace via steam/origin/app store if I wanted. Most of the games I've bought on cds I could get from one of those places for the price of a cup of coffee in central Helsinki. I try not to run around screaming about drm robbing me of my rights, though. You're a cheery wee bugger, Nep. Have I ever said that? Reapercussions

Zoraptor Posted April 24, 2013 Posted April 24, 2013 (edited) My attitude is that if publishers are insistent that they're selling a licence rather than a product then that means that format shifting is aOK. And now we have the intellectual justification for Pirating, I was wondering when someone would make a similar argument. But you are still still stealing and breaking the law, but if you sleep fine at night thats good news Ah, but I didn't break the law. I downloaded a copy of something I already had the right to use for single person licensed use. I didn't make copies of it beyond that, never on sold it while retaining a copy myself and did not allow others to make copies; I never even installed it on multiple computers that I own myself. All I did was treat it exactly as what the publisher says it is, a licence to use rather than a physical good. And spend about five days downloading the thing on dial up. That's the goose/ gander thing. "It's also funny that most publishers argue that they are selling a service, not goods....right up until the moment you want them to act as a service provider. Then they treat your purchase as if it was goods, not a service" pretty much sums it up to a T. If it's a licence then it's a licence, both parties get the benefits of it being a licence as well as the negatives. You cannot have your cake and eat it too- though if you've got good lobbyists and a few pet politicians- or corporate lawyers- you can certainly try. Nonek Posted April 24, 2013 Posted April 24, 2013 I'm often surprised by just how much the publishers get away with, I see nothing in always online, clients or excessive drm requirements that benefits me as a player, and so mostly I shun or sandbox them. If they want my business they'll have to try and get it through making their offers enticing, rather than punishing me for piracy that I have never and would never commit. Quite an experience to live in misery isn't it? That's what it is to be married with children.I've seen things you people can't even imagine. Pearly Kings glittering on the Elephant and Castle, Morris Men dancing 'til the last light of midsummer. I watched Druid fires burning in the ruins of Stonehenge, and Yorkshiremen gurning for prizes. I'm sure a lot of people would've paid extra to miss the boss fights in DXHR... Of course, now they've come out with the WiiU version, which does pretty much that (new boss fights, more in the missing link style - with missing link also rolled into the main game). Raithe Posted April 25, 2013 Posted April 25, 2013 Games without bossfights are same as sex without orgasm... I wouldn't put it in quite that vein. After all, there are times when you can have a really great story in a game that you're enjoying, and then you end up with some annoying as get out, grindy, nonsensical and fairly meaningless bossfight that isn't about skill, technique or character.. but about mashing a few keys repetitively to avoid the boss attacks, while you slowly whittle down their 200k+ hit points using only specific moves because the bastard is invulnerable except in specific instances... If orgasm was like that, people really would stop having sex.. "Cuius testiculos habeas, habeas cardia et cerebellum."
