  1. is predictable but still vulgar how many republican legislators and pundits is opposing impeachment 'cause such would be divisive with the potential for angering trump's supporters. after the election, there were many observers who lamented how the President and his cronies pushing a wholly unsupportable narrative o' election fraud were divisive and dangerous. and again, mr. sterling is a hardcore republican who were participating in advancing voter suppression in georgia leading up to the election but even he couldn't accept what was happening. trump supporters responded that they were just exercising their legal rights in an effort to defend democracy, in spite o' fact that there were never any genuine evidence supporting their claims and recognizing how in court giuliani and others repeated denied they were claiming the existence of election fraud. the volatile and divisive atmosphere which led to the disturbing events at the Capitol were created by trump, his legal team and all too many legislative allies but now those same trump supporters is using the danger they created as an excuse to insulate the President from any kinda punishment? ps still no federal level briefing on the events at the Capitol? really?
  2. am thinking bruce should at least reconsider using an unprecedented attack on the US Capitol by trump supporters, including individuals now identified as being white supremacists and diehard qanon members, as a transparent excuse to resurrect his equine necrosis gripe 'bout how individual municipalities and cities handled their protests this summer. the alt-right and denialist trump supporters is using a tactic from the putin/ussr playbook to distract as they grab for issues meant to change the topic from the lurid events o' the day. am not believing bruce self identifies with such corrosive elements, but he is nevertheless engaged in tactics of evasion and misdirection. bruce may discuss whatever he wants, but am thinking he should at least reflect on what his dogged pursuit o' the summer protest topic says 'bout him given the events o' January 6. if the story o' the day were 'bout how a young woman walking home from church was brutal murdered by white supremacist and you saw a fellow poster trying to change subject to just how many people are killed by non-whites each year, you would recognize such as transparent and offensive distraction, no? there is individuals on this board who reflexive indulge in whataboutism and they are hopeless. am not thinking bruce is hopeless. take a moment and reflect. there is a time and place for discussing the summer protests. you had plenty o' opportunities to debate blm protests during the summer and you will have many chances to do so in the future, but genuine consider if you wanna be lumped in with the kinda folks who is trying to distract from the events o' January 6. is your choice.   3. consider: as of 1/9, there has been no federal law enforcement or wh briefing regarding the events of 1/6. we had a statement from the press secretary condemning violence and a couple conflicting videos from trump, but no informative briefings following an attack on the Capitol. nobody is shocked by the failure o' this Presidential administration to face the press following the events at the Capitol, but we should be.   4. it would be sad if it weren't so illustrative that the people who were pushing the trump derangement syndrome narrative for the past four years would indulge extreme cognitive dissonance to maintain their initial belief. what did they convince themselves they were seeing on january 6, 2021? terrible reality is that january 6 trump wasn't different than the trump o' the past four years. bad luck. antifa infiltrators. nowhere near as bad as the media makes it look. etc. pile on the excuses to maintain the increasing unsupportable narrative. henceforth, TDS only makes sense when used ironic, intentional or otherwise, 'cause trump keeps managing to do the improbable, the unthinkable and the impossible and yet there is people who act as if each o' these events is isolated and insular. most o' us expected some degree o' trump inspired nonsense on january 6, but too few in power planned for the worst and so the unlikely and improbable somehow becomes inevitable in retrospect? the President is ignorant, erratic, and narcissistic and he is not gonna somehow get less ignorant, erratic and narcissistic in the next eleven days. assume he is gonna get worse is the prudent course of action. mattis was sleeping in his uniform when trump was demanding action against north korea early in his Presidency, and recent every living former secretary o' defense joined an opinion piece article which recognized the serious threat trump posed to the republic in this the last month of his term in office. shoulda' been a wake up call. wasn't. same trump at start as end, but with criminal charges looming as soon as he leaves office, trump is more desperate than at anytime previous in his Presidency. you cannot full prepare for what trump will do, but is prudent to assume that whatever you might imagine, the reality will be worse.. and more stoopid. no, am not expecting trump will successful start a war or sacrifice 10,000 of his followers to baphomet as part o' an infernal pact to retain power. am not knowing what to expect but am hopeful those in the white house, pentagon and Congress are prepared for something terrible, 'cause even if terrible never happens, with trump the improbable, unthinkable and impossible is... not. we expected chaos on january 6. we warned o' chaos. we didn't imagine what actual happened, not by a long shot.
  5. the fbi and other US intelligence and security organizations keep stressing how right-wing groups is the most serious domestic threat in the US. you would think that events which attract large numbers o' such individuals would result in more robust law enforcement presence than we saw for the catholic nuns protesting daca in 2018. slight hyperbole. slight.   6. five people have died from the chaos o' the riot at the capitol. how many will die 'cause during the worst week o' the pandemic in the US thus far, trump called tens o' thousands o' his supporters together from across the nation, ignoring cdc & state health department travel guidance, so that his maskless and non social distanced fans could engage in a super spreader event which didn't even manage to remain an outdoor event? got $20 says the number is more than five. is this tacit recognition that things has indeed gotten worse since 12/22/2020? our hope is that the worst comes w/i the next couple weeks, followed by relative dramatic decreases in mortality as hospital numbers drop below levels which is current impacting quality of care. would be nice if vaccine distribution were occurring better than predicted as 'posed to significant worse. who woulda' guessed that w/o a plan or coordination there would be similar chaos for vaccine as there were for testing... testing which is once again almost useless as we may personal attest. four days after first symptoms is when we could get a appointment for a test. five days from test is when am expecting results. january is gonna be bad and will likely get worse in many parts o' the US. unnecessary bad. there is an end in sight, but it will get worse before it gets better. is no magic ritual or vaccine which is gonna change the short-term pain. we all know what we should be doing; no need to repeat. try and stay safe, and consider how your actions affect others. as an aside, given our current flu related headache (different but only slight better than our migraine with aura experiences) am willing to consider inca skull surgery to relive the pressure am feeling.   7. summer police protests were complete different than january 6. https://forums.obsidian.net/topic/120436-politics-us-election-edition-2020-almost-over-read-all-about-it/page/9/?tab=comments#comment-2247485 of the many thousands o' summer protesters, there were indeed a few (too many btw) who committed vandalism and arson and assaults and those individuals were criticized as they deserved to be. some elements o' the left did indeed appear to minimize the violence, and we were bothered by a few congressmen who started gofundme efforts to post bail for counter protesters who became violent and were arrested, but folks such as bernie sanders and joe biden consistent criticized any who used violence or crossed line into lawlessness. belated, the wh seemed to embrace Gromnir's perspective on protests. during the summer, the wh ignored the many thousands o' peaceful protesters and instead condemned all because o' the bad actions o' a few. converse, many thousands o' rioters broke into the freaking Capitol during the the counting o' the electoral college votes with legislators present. am not suggesting those peaceful trump protesters who did not trespass and loot and vandalize and assault is guilty o' any crime. am not criticizing those protesters who did not join the riots save for their disappointing willingness to buy into the false narrative o' the stolen election. the bad actors need be held accountable. however, protesting, in and of itself, is not a bad action. non violent protests is every american's right and is arguable their duty. march on streets, which is specific recognized as public fora by the Court, is perfect legit and legal even if it inconveniences a few and regardless o' whether it results in a few individuals taking the protests too far. charge the individuals. punish the individuals. as to reaction to police brutality events our advice consistency is quixotic. we always recommend wait for more info before knee-jerking, just as the kenosha story changed soon after the initial reports, so to does the details o' many/most police brutality stories... and so many other stories which enrage and enflame passions. wait. we advise wait. however, again, is american to protest. even if we believe is unwise to protest before wait for more clarity, is nothing illegal 'bout doing so. we have personal put our reputation and personal safety on the line as we represented kkk and gang members as they demanded equal treatment from the government and their day in court in an effort to enjoy same free speech and association rights as blm. HA! Good Fun! ps if you don't like how the state and local police addressed protests, then take up with those states and municipalities. the fed had no power to intervene with force. individual municipalities made hard choices 'bout how best to deal with violence, which the fed actual exacerbated (please note how after the fed presence disappeared, most protests dwindled and died) but those cities made such decisions insular and discreet from the fed. put heavy armed police in front of peaceful protesters condemning police had predictable result o' resulting in even more anger... and again, january 6 were different as there were many thousands engaged in overt lawlessness which put lives in danger as well as property.

"why even bother," is a more relevant question unless the goal is disqualification, 'cause trump will likely be out of office before a senate trial is concluded. a 2/3 conviction removes from office and disqualifies. am suspecting very few folks realize that the senate does not need 2/3 to disqualify, but such will become known soon.   10. obvious reason to do so is precedent. fact there is only a few days left in the administration should not preclude some kinda meaningful response to the excesses of this Presidency. first ever President disqualified after a second impeachment? will be historic relevant. meaningful more in future than today. trump will be the answer to trivia questions and multiple choice civics exams 'bout the only two-time impeached president. 100 years from now school kids will have difficulty recalling why john quincy adams was a President of significance, but they will likely know trump and they will know for infamy. is also a possible misunderstanding regarding trump popularity and disqualification. trump is popular in many parts of the country. trump current has zero chance o' being reelected as President four years from now (situation can change,) but he could win as a Congressman from florida. be denied this possibility would be significant. whatever ego boost trump gets from being victimized by democrats AND republicans (as we noted, this won't work political w/o republicans) as he is shown the door and excluded from the political process, it will be equal emasculating to be kicked out of washington... forever. ultimate indignity. trump has always railed 'gainst being excluded from the old money elites o' ny society who always treated him little better than the serving staff. excluded is not something trump handles well. a final indignity to a President who lost house, lost senate and lost Presidency? trump is gonna play the victim role regardless. might as well give him something to genuine cry 'bout and doing so would be precedent setting.   11. worth mentioning 'cause we ain't seen it yet suggested, but as 'posed to 25th amendment (unlikely for political and mechanical reasons) or censure, (*snort*) impeachment for purposes o' seeking disqualification does not require a 2/3 majority conviction in the senate. the senate may vote to prevent trump from ever holding future public office by a simple majority vote. as such, Congress, as punishment, could prevent trump from ever seeking elected office in the future. am suspecting a few democrat legal scholars is considering this possibility if not now then once they attain a senate majority, though am thinking to make it work politically, you need at least a few republican senators to sign on to the move.   12. have been hesitating to mention the legal stuff in part 'cause am gonna be disappointing a few. the individual rioters is gonna be subject to all kinda charges many which is so obvious we don't need mention, but am suspecting people have heard 'bout "sedition" mentioned much. 18 sections 2383 and 2384 is the most likely options beyond the vandalism o' fed property stuff, but keep in mind that as dramatic as seditious conspiracy sounds, the penalty is 10 years in prison and inability to hold public office in the future. the penalty for those who, "knowingly enters or remains in any restricted building or grounds without lawful authority to do so," is up to ten years in prison, and a recent trump executive order made clear such violations were to be punished to the maximum allowable by statute. the goal o' the rioters is gonna be individual, but please keep in mind that an intent to overthrow the government is not required for insurrection. the intent to delay the legal recognition o' the electoral college results would be enough 'pon which to hang a charge o' insurrection. any act o' force coupled with requisite intent is gonna trigger 2383, and trespass past barricades and police is an act o' force from a legal pov. a whole lotta protesters is gonna be subject to insurrection charges. 2384, conspiracy, is the more difficult o' the two sedition charges to bring 'gainst the rioters 'cause as we keep mentioning, this were a mob. conspiracy requires coordination and organization. a handful o' the rioters made their plans known via social media, and those folks will indeed be subject to conspiracy charges if they had any kinda plans with fellow protesters to do mischief (a backpack full o zip ties and emails to their fellow proud boys would be enough) but the vast majority o' folks will be subject to 2383 as well as 18 sec. 1752 as 'posed to conspiracy. most people wanna know 'bout trump and giuliani and the other speakers who got the crowd worked up and exhorted 'em to the march on the capitol to do harm. ... we mentioned this a while back when addressing why a nutter publishing his manifesto were not gonna result in incitement charges, but the brandenburg test requires: 1) speech “directed to inciting or producing imminent lawless action,” and 2) the speech need be, “likely to incite or produce such action.” *sigh* need satisfy both aspects and neither is a slam dunk for any o' the speakers who were egging on the protesters who would eventual become rioters. part o' the problem will be the hundreds o' times in the past trump has made similar inflammatory comments which did not result in riot, and rudy's "trial by combat" bit were just so bizarre that prove such would likely result in a serious call to arms would be a stretch. there is at least a good argument that trump and others wanted a crowd to march on the capitol when he made his comments, and based on reporting that trump were initial pleased with the lawlessness at the capitol will be relevant in a possible criminal action, however, given how erratic is trump, attempting to ascribe concrete motivations to anything he says is just such a crap shoot. the terrible reality is that the past four years o' bad behaviour and borderline insanity from trump helped to insulate him from a possible incitement charge. trump is so consistent erratic as defy any sorta attempt to divine intent and his bad speech is the norm as 'posed to the exception. furthermore, the resulting lawlessness might not be imminent enough to satisfy brandenburg. am knowing this is hard to accept, but first amendment protections is no joke, and when the Court speaks o' imminent for the purposes o' overcoming free speech protections, they has in all case law meant the kinda imminent which is offering an extreme limited temporal window. might as well be read as "immediate." may not seem logical, but fact you had folks riot after hearing trump(s) and giuliani is not meaningful proof that those speakers were producing requisite incitement for purposes o' overcoming first amendment protections. HOWEVER, am also recognizing that now that a cop died, is much more likely a prosecutor would take up the case. a jury is gonna want to hold somebody responsible, and a cop bludgeoned to death with a fire extinguisher is gonna have many/most juries looking for an excuse to hold somebody accountable. two cents worth o' feedback. HA!   14. edit function on previous post is wonky, so apologies in advance for the double-post biden being critical o' the rioters on January 6 is the right message. the gatewaypundit/zerohedge/qanon nutters need to be disavowed. the actions of these folks need to be rejected not just by Biden but by the republican establishment. fringe. they were fringe before bannon and trump legitimized. they need be rejected by republicans today and not legitimized by biden. that said, we welcome any trumper who is willing to peaceful protest. while we disagree with too many of them and am profound disturbed by the willingness to embrace conspiracy theories which confuse "mere possibility" with "fact," we will fight to the death (metaphorical as we will put self in harm's way before we cause physical injury to another) to preserve their right to protest... to the extent o' the first amendment and perhaps even a bit beyond. however, am drawing the same line biden, harris and lewis drew-- No Violence. failure to condemn violence is unacceptable.   16. or you had a false negative, which is unfortunate too common. false Positive is improbable, but negative is a different situation. hope you feel better soon. as an aside, we got our covid-19 test last night at 7:00 pm and were told it were likely we would get results in five days. five days. am personal feeling terrible at the moment, but our discomfort is probable the garden variety flu (which is pretty unpleasant as we ain't been able to sleep for more than an hour at a time 'cause o' muscle aches and such for four days) and am expecting a negative result... which is too bad 'cause am not even gonna have covid-19 antibodies following this bit o' illness which we expect to last the ordinary seven-to-ten days. only positive o' getting the covid test: we took a shower before our appointment. unlike many covid sufferers, our sense o' smell is quite good as we were able to tell just how fetid we had become after four days o' cold sweats w/o taking a shower.   18. more than a few o' the protesters thought they were participating in a coup. more than a few thought they were peaceful protesters exercising their first amendment rights. again, it were a disorganized mob and attempting to ascribe some kinda motivation or plan to the entirety is pointless. It’s the People’s House, but the terrorists behaved as if only they should have the keys to the Capitol. One man sat in Nancy Pelosi’s office, his feet contemptuously propped up on her atop the desk and a smile on his face. Others charged at a member of law enforcement, left alone and unable to handle the mob’s surge. We saw them literally on the walls, hanging from a ledge in the Senate chambers or outside, swinging on the scaffold. Others took selfies and souvenir photographs, as if the mob’s intrusion were merely some Capitol tour gone awry. A door featured the newly scrawled threat: “Murder the Media.” Others were seen with guns, and zip ties, apparently prepared to take hostages. Washington, D.C., police found explosives near the building. A man stood where Vice President Mike Pence typically sits in the Senate chamber, taking it upon himself to declare that Donald Trump had, indeed, won an election he lost. The entire scene was a violation in the purest sense, and on top of all that, the lack of protective face coverings amid the pandemic betrayed both a lack of sense and shame. yeah, more than a few o' the qanon folks with their Storm prophecy thought The Day had finally arrived. more than one trump supporting Congressman boasted that January 6 would be a 1776 moment for the maga movement... whatever were a mob. The Confederacy were wrong, and slavery were/is integral and unavoidable linked to perpetuation o' the lost cause myth, but try and distill the perception on the ground o' the confederacy is impossible. a soldier from virginia and a plantation owner from south carolina and James Longstreet might have been equal devoted to the confederate cause, but their reasons for doing so woulda' been different and even impossible to align. those involved in the january 6 mob were all wrong, but they were wrong unique. some kinda generalized perception on the ground is an unnecessary rabbit hole even if it will be debated endless.
