Kaftan Barlast Posted October 12, 2007 Posted October 12, 2007 Ive recently reigstered my own domain and a host server in Florida, which makes the website fall under US jurisdiction. Now, Im going to publish some pretty weird and fun stuff incluing a forum, but I dont know whats legal in the US. In Sweden, you can post anything except child porn or racist or anti-gay material. DISCLAIMER: Do not take what I write seriously unless it is clearly and in no uncertain terms, declared by me to be meant in a serious and non-humoristic manner. If there is no clear indication, asume the post is written in jest. This notification is meant very seriously and its purpouse is to avoid misunderstandings and the consequences thereof. Furthermore; I can not be held accountable for anything I write on these forums since the idea of taking serious responsability for my unserious actions, is an oxymoron in itself. Important: as the following sentence contains many naughty words I warn you not to read it under any circumstances; botty, knickers, wee, erogenous zone, psychiatrist, clitoris, stockings, bosom, poetry reading, dentist, fellatio and the department of agriculture. "I suppose outright stupidity and complete lack of taste could also be considered points of view. "
Tale Posted October 12, 2007 Posted October 12, 2007 Child pornography, copyrighted works (excluding for Fair or licensed use). Outside of that, possibly threats, but would depend on whether or not they're serious. "Show me a man who "plays fair" and I'll show you a very talented cheater."
Kaftan Barlast Posted October 12, 2007 Author Posted October 12, 2007 What about slander an libel? And wird anti-terror laws? Walsingham Posted October 12, 2007 Posted October 12, 2007 I think slander and libel are pretty esoteric in the States. I can't remember how, though. "It wasn't lies. It was just... bull****"." -Elwood Blues tarna's dead; processing... complete. Disappointed by Universe. RIP Hades/Sand/etc. Here's hoping your next alt has a harp.
Tale Posted October 12, 2007 Posted October 12, 2007 (edited) Slander and libel can be issues. There are no anti-terror laws preventing you from saying something over the internet. Unless, of course, you start making threats that are reasonably viewed as sincere. Since you have an actual hosting company, you need to ask them these kinds of questions. They can shut you down even if you're not violating any law if they dislike your site. Edited October 12, 2007 by Tale "Show me a man who "plays fair" and I'll show you a very talented cheater."
Gfted1 Posted October 12, 2007 Posted October 12, 2007 Why would you get a server in the US and not in Sweden? "I'm your biggest fan, Ill follow you until you love me, Papa"
Enoch Posted October 12, 2007 Posted October 12, 2007 I think slander and libel are pretty esoteric in the States. I can't remember how, though. Defamation torts (slander & libel) are still valid causes of action in the U.S. But if the person being slandered is considered a "public figure," the 1st Amendment offers broad protection to the speech. New York Times v. Sullivan was the landmark SCOTUS case that broke the U.S. away from the British common law tradition on defamation. Apart from that, there are some obscenity restrictions (most notably the aforementioned kiddy porn). And try not to violate U.S. Copyright laws or incite any imminent lawless activity. (See Brandenburg v. Ohio.)
taks Posted October 12, 2007 Posted October 12, 2007 and whatever you do, don't publish any threats towards any government officials (particularly the president) or the secret service. they take all of those seriously, even if it is obvious they are meant in jest. taks comrade taks... just because.
Spider Posted October 13, 2007 Posted October 13, 2007 Note that if you're residing in Sweden and have a website directed at a Swedish audience, you have to abide by Swedish laws. Sure, they can't close the site down, but they can take action against you. Also, Swedish websites are not quite as protected as you seem to think. They do not enjoy the same protection as print magazines in regards to freedom of speech, unless a few conditions are met (one being paying a license fee, another keeping an archive with every change ever made to the site). For instance, you're not allowed to talk about a persons medical history or other personal details without consent. And as I said, this applies whether or not the site is physically located in Sweden. There are a few more exceptions though, but the law is mostly a paper tiger anyway. No one has the time or the inclination to go after the harmless stuff.
Kaftan Barlast Posted October 13, 2007 Author Posted October 13, 2007 Are you sure about that, Spider?
