His defence would be that he obviously wasn't trying to kill the guy, because you couldn't miss by accident at such close range. If this is old news, was he eventually convicted?

Similar to another surprise wounding/attempted murder I witnessed. The victim looks fine for a few seconds, then *poof* they realise how bad they are and collapse.

 

This illustrates why the cops have to shoot for the head in hostage situations. You can't be sure the target will stop moving with anything less.
