  3. am knowing for most folks the ol is a secondary concern, but for the cowboys, more than even mosts teams, the ol is the driver o' success, and the cowboys ol is nowhere near 100%. tyrion smith is sidelined and la'el collins were questionable even before he left the game... and zach martin is playing hurt. am knowing we sound like a broken record talking 'bout cowboys and the ol. after all, every team has some ol attrition during the year, so is not as if cowboys is in a unique situation. however, given dak limitations, the cowboys is particular ill-suited to overcome ol problems. is tough to describe just how basic is the cowboys offense and am seeing no reason for such other than minimizing dak mistakes. until the ol situation gets right, which doesn't look like is gonna happen soon, the cowboys will continue to struggle 'gainst all but the cellar dwellers defenses in the league.   9. am admitted intrigued by this. no, am not particular interested in using blood as a substitute for egg, but rather the reverse. obviously the flavor produced by egg and blood is different, but is a number o' recipes we use which call for non-human blood both to flavor and thicken. haven't actual tried in any baking however, though there is a pancake recipe... try and convince some folks to try czernina or black pudding is not easy, and doesn't strike us as fair or ethical to trick folks into tasting w/o informing. am curious if we could approximate similar flavor w/o needing use actual blood... kinda get a person's feet wet, so to speak, so maybe they is then curious enough to try the authentic.   12. we got a couple french onion soup recipes. our standard uses gruyère as cheese, and a white wine, a bit o' white wine vinegar and perhaps a splash or two o' sherry. we do make a french onion which uses red wine or even port instead o' white. in such cases am more likely to use appenzeller as is a stronger cheese than gruyère... though is not any cheaper if that is a concern. regardless, starts with the broth. put a little more effort into broth and you end up with a win regardless o' cheese or wine choice.   13. yeah. the notion a person is getting away with something ignores what we said 'bout negligence being more appropriate to civil. we specific used examples o' doctor prescribing wrong medication or construction worker wrong building scaffolding when explaining texas cop case. make a mistake does not mean you ignore consequences. not go to prison is hardly the same as getting away with something. however, shoot somebody is fundamental different... but less so in USA as 'posed to almost anywhere else. sure, far more people die every year from prescription med mistakes than all firearm crimes and accidents combined. nevertheless, while meds may be as dangerous as firearms, the purpose o' the gun is to cause hurt or death. guns is different, or should be. if you use a firearm on a person, is expected somebody will be severe hurt or dead. prescription drug is not intended to harm. am getting the consternation and the dissatisfaction. we want to get justice for victims, and innocent people being shot and killed feels like a situation where justice is demanded. nevertheless, even when is an option for da to do so, we typical do not criminal prosecute mistake for intent crimes. is rare. is the exception. even the vehicular manslaughter stuff is rare unless is a repeat offender o' dui... or if the incident gets disproportionate publicity 'cause child dies or some other reason.   14. we explained earlier in the thread how drug use would alter, and have mentioned previous how drunkenness effective replaces intent from a legal standpoint. the intent to get drunk is, for purposes o' the crime, fulfillment o' the state of mind requirement. drunk isn't illegal, but driving drunk is. had requisite intent for the drunk driving criminality. drunk driving results in death o' another is not considered an accident, unless you were slipped a mickey or somesuch. can't check for alcohol level at this point anyway. if weren't already checked... not that would matter 'cause drunk in home is not illegal. Gromnir may believe such behaviour is stoopid and prohibitive likely to result in a harmful or fatal mistake, as it did in this case, but such is law. jehovah's witnesses show up to proselytize and you wanna answer your door with your ar-15. is not inherent unreasonable or reckless to do so. more important, and again, we rare criminal prosecute mistake. shooting somebody who leaps outta bushes and growls is reasonable? not in our mind, but do you really wanna imprison a guy for a stoopid mistake? even if mistake is moronic and terrible we general don't criminalize. after all, negligence is ordinary a civil issue. for intent crimes we are seeking justice for folks who got genuine ill will. accidental kill the birthday surprise guy is subject matter for a far side comic as 'posed to fodder for criminal courts. shrug off and say this were yet another example of florida man? am understanding frustration. unsatisfactory. and again, am personal not sympathetic to shooter. investigate and find out there were no growling and leaping from bushes, shooter simple opened the door and shot. fine. gonna csi that and check for footprints in bushes and whatnot? ok. am not sure what the cops did, but am doubting they didn't at least ask questions o' witnesses. so, what else? keep in mind that if a month from now somebody discovers email evidence that the guy from norway were shot not 'cause o' accident but 'cause the shooter were a greenpeace fanatic who secretly loathed his norwegian in-law 'cause o' norway's stance on whale and seal hunting, then is not as if the shooter couldn't be prosecuted at a later date. were son-in-law who died trying to surprise somebody on their birthday. am suspecting cops quickly saw just how tragically perverse and utterly human the situation was.   16. biggest problem is vocabulary, which am suspecting is not actual accident. if law weren't arcane, then people wouldn't need lawyers... or at least not need as often. words like malice and intent don't actual mean same thing as they do in english. am suspecting lawyers as an industry has created impenetrable vocab just to make themselves indispensable. am thinking we mentioned at least once before how in spite o' fact most o' our acquaintances over recent years has been attorneys, and even 'mongst those we genuine respect, is few with whom we would wanna go to a ballgame. is not that we dislike fellow attorneys, but am finding we have little to talk 'bout with most attorneys save for law... and as am a Con Law guy, we get the kinda dismissive, "you poor soul" treatment from fellow folks in the profession. 'less there were some kinda obvious evidence that the shooter had planned this, occam's razor says mistake... accident. at best you maybe find an argument for negligent homicide. we mentioned earlier in the thread how regardless o' how laws is written, mistake and accident do not get prosecution unless there is some other overriding factor. yeah, we punish all kinda people for all kinda minor stuff. nevertheless, in spite o' what recent cases and tv and movies lead you to believe, if cops and da believe is mistake or accident, then any intent crime typical goes unpunished. however, there is a whole bunch o' crimes we punish regardless o' intent. speeding ticket? toxic waste dump? drug possession? most crimes is actual mala prohibita as 'posed to mala in se and it don't matter what the defendant's intent were. confused? probable. is worth doing a quick looksee at mala prohibita v. mala in se if you are genuine curious.   22. impeachment isn't a criminal justice issue. individual articles o' impeachment is gonna be discussed and voted 'pon in house committee, and then entire house of representatives will vote on each article which successful gets outta committee. legal? is wrong way to think 'bout it. the Court is final arbiter o' legal in this country, but the SCOTUS will not intervene and render decisions on the issue o' impeachment, save to acknowledge that they cannot issue a decision regarding impeachment-- is a separation of powers issue and is non justiciable 'ccording to the Court. the President and and the executive branch obvious cannot render some kinda binding rule or finding 'bout impeachment neither. ask what is legal is wrong question 'cause even if there were some kinda legal, nobody but Congress could decide such. hypothetical: nancy pelosi, in an attempt to win over southern democrats and evangelicals, announces she is leaving trump's impeachment fate in "God's hands." to that end, every member o' legislature gets to pick a bingo card marked alternatively yay or nay. instead o' vote on articles o' impeachment, the House holds impeachment bingo on each article of impeachment. bring in that little girl from sweden to pick the bingo balls and maybe have that guy from boxing announce the numbers. legal? doesn't matter if is legal 'cause nobody with authority under the Constitution has power to challenge the issue.   23. we were talking 'bout juries earlier, so kinda a segue. has been explained to us that older women is notorious critical o' younger women. complete ignores ethnic. defendants and attorneys who is younger women, particular if the younger women is forceful, get extreme slim margin o' error from older women. am suspecting the tendency o' older women to be hypercritical o' younger women is not limited to jurors. am personal not a fan o' harris so somewhat skews our judgment o' her electability. the way she went after biden on the busing issue were calculated and underhanded, particular as harris, when asked day after the debate, admitted she were not necessarily advocating federal forced busing either. that said, while am not a fan o' harris, we can see how she might appeal to independents. in a close election, particular given polarization which exists today, independents is the folks who nevertheless have potential to be swayed, and given their numbers, they would once again determine the winner o' the election. yeah, harris is gonna immediate be dismissed as viable by any 2nd amendment advocate, but as with much o' the country, independents is trending towards increased gun regulation... though 'course such trends only matters in battleground states. am suspecting harris' tough-on-crime record as a prosecutor is gonna play well with those conservative independents who is losing patience with trump but who might similar be unable to vote for bernie or warren. but again, am not a fan o' harris. she has kinda adopted trump's style o' rhetoric which is heavy on making promises impossible to fulfill, promises which nevertheless resonate with the electorate. am not saying harris is as bad as trump, but am not wanting to see appeals to fear and ignorance becoming the winning strategy for Presidential candidates. call us provincial.
