Just because it is on disk does not mean that it is accessable to the player in normal course of gameplay. Only normal course of unmodded gameplay should be considered for the rating.

I don't thikn that Jade Empire would work well on the PC in the way the gameplay was set up for the X Box.

I disagree, SP. Anyrhing that requires a third party modification to give access its a mod and shouldn't be in the final eqution for the rating.

As I said on the Elderscroll forums: "...it still requires a mod to access the files. That is the bottomline here. A MOD is required to access the nudity. Listen to what I am saying... The game is modified by a third person therefore a mod, regardless the files being left in or not.

I can think a more interesting mod that can go with the nude mod for that game, Calax.

In any case moddable games will more than likely will get a Mature rating just in case someone makes nude (OH NOES) skin for it.

If the base game has to be modified to have access to that file then it is a mod, because normally the game does not access that file at all. There or not, if it is inaccessable during normal gameplay then it is irrelevant.

Yep. Thanks to the stupidity of the US culture of sex being bad and mass murder being good, third party mods that depict nudity will up the ESRB rating. Third party mods that the publisher and developers HAVE NO CONTROL OVER.

If you have to change the game files in order to produce a result it is modding, regardless if the files were on the disk or not. Any modification to the game done by a third party source I consider a mod.

So, they should mark every game AO for the possibility of them being modded *gasp* to have nudity and simulated sex. Makes one think if some talented modder can put nude mods and a sex scene in a Barney game. HA!
