Can't select Expert Mode?

I'm obviously missing something... the Expert Mode option is greyed out and unselectable.

 

 

...nevermind; I assumed you could select it at the start screen.

you can select it after starting a new game, the options screen one is for turning it off again

You can only select Expert mode when starting a new game, and you can't get it back on once you turned it off.
