I get more and more confused about this. Apparently SEGA OWNS the trademark but why did Patrick Miles on Something Awful believe that Obsidian has it.

If OE really owns any of it, I hope they go forward with making another and selling publishing rights to a publisher that will actually take care of this game. AP is one of the best RPGs of 2010 so far, and it really deserves a sequel.
