What happens is apathy among voters, misinformation, shilling, cronyism, plain old corruption and outright idiocy often allow small groups to exert influence that is disproportionate compared to their actual size. Capitalism's commodification of identity in action. Communism, anarchism, fascism, etc; these are no longer concrete political movements but commodities, products to consume and provide a sense of individuality. However just like every other product these ideologies have an expiry date and so the consumer will toss the ideology aside and move on to something else. Sorry but you are way off here. If the law favors the majority over a minority the judiciary (acting properly) will follow the law. And vice versa. I probably should not have said primary, but if that law violates the constitutional rights of a minority, it is the judiciary's responsibility to challenge the law. Now I am now lawyer, so I totally could be talking out my butt, but that has always been my impression. Of if any party is harmed by the extra legal activity of another then the judiciary has a responsibility to uphold the law. That is the whole idea of "equal protection". Of course there have been many times they have not. Just ask Dred Scott, Carrie Buck, or Susan Kelo. But if the law favors the "evil corporation" over the "benighted and oppressed minority" then the judiciary has a duty to act on the behalf of the "evil corporation" if theirs is the legally sound position.
